A BILL to amend article five, chapter eighteen of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
fifteen-f, relating to education; county board of education;
and developing guidelines for individualized education
process for special education students placed in a regular
classroom setting.
Be it enacted by the Legislature of West Virginia:
That article five, chapter eighteen of the code of West
Virginia, one thousand nine hundred thirty-one, as amended, be
amended by adding thereto a new section, designated section fifteen-f, to read as follows:
ARTICLE 5. COUNTY BOARD OF EDUCATION.
§18-5-15f. Development of policies and procedures for
individualized education process.
County boards shall develop appropriate policies and
procedures for implementing policy of the state board of
education relating to the individualized education process and
what is commonly referred to as "inclusion." These policies and
procedures shall assure that discretion and proper judgment are
exercised in the placement of special eduction students in a
regular classroom setting for full-time instruction.
NOTE: The purpose of this bill is to require county boards
of education to develop policies and procedures relating to
"inclusion" or the placement of special education students in
regular classroom settings.
